When I record or stream with Elgato hds60+ capture card it freezes occasionally

so like in the title, When I record or stream with Elgato hds60+ capture card it freezes occasionally, and until I deactivate and reactivate it, it doesn't fix itself. And the FPS drop is so much when I start recording or streaming. I had no issue whatsoever 2 weeks ago but now I can't stream with my ps5.
The things I tried:
changing the usb ports of the capture card
changing the cables direction
installing capture cards drivers
AFTER I realised the problem was not with the capture card but with the obs I tried
different settings
going back to previous release
delete and re install obs studio
Nope, none of this fixed my problem. when I don't record or stream, the preview looks just right, and no problem what so ever. But as soon as I press record or stream, it has devastating fps drop and then it freezes completely... I believe it started after the latest update 28.1.2. but reinstalling it didn't fix it unfortunately. I haven't deleted the settings when I uninstalled obs studio, but I don't know if it has anything to do with it or not. I had no problem 2 weeks ago...
