Unfortunately there isn't much that can be done to fix this on our end. I think the best solution is for an Nvidia driver update that reserves VRAM for NVENC. Until then, lowering your settings to reduce VRAM usage is the only workaround.
I'm experiencing this error consistently when "window keying" out of game while OBS is up and streaming. But it doesn't occur until I try to go back to game on main screen. For now I'm just not tabbing or windowing out of game during stream while play COD: Modern Warfare/Warzone. Anyone else have the same result?
Call of Duty Modern Warfare (2019) runs fine until trying to create a 'Game Capture' source of the game in OBS Studio. At that point the "DEV ERROR 5761" will appear and crash the game immediately and on subsequent launch attempts.

I Found a solution, i made a video to help but its in portuguese but i think it may can help you only by watching it!
the problem with nvidia filters with obs "game capture" or "Window capture" so you shouldnt use those source options. you must to choose "DISPLAY CAPTURE"!
