Question / Help QuickSync : 4 Ref Frame impossible ?

I have tried to use 4 ref frame with Quick Sync for 1080p 30fps 3500kbps but with "Mediainfo" i can see 5 ref frame which break the 4.1 level of h264.

Is this a bug or QuickSync does not allow to select 4 ?
