Question / Help OBS on Win10 Build 9926 framerate issues using NVENC

I used OBS with few issues on Win8.1. Sadly I had major issues with Win8.1, even started using my UbuntuGnome drive as my primary OS for quite some time. I installed build 9926 of the Win10 technical preview with no issues. Drivers all installed correctly including my GPU and chipset drivers. I am using a Asus G750JM as my main rig currently. When using OBS in file-output only mode my settings are as follow: Encoder: NVENC, CBR: Enabled, CBR Padding: Enabled, Max Bitrate: 48000, Use Custom Buffer: Disabled, Resolution: 1920x1080, Framerate: 60 fps, and NVENC preset: NVDefault. I also run OBS in Windows 8 compatibility mode.

Should I use different settings? Run OBS in a different compatibility option? etc.

To give some insight on what is happening, when I am playing Heroes of the Storm (Blizzard games also tend to cause video_internal_management errors under Win10) I average 78-85fps maxed out. When I begin to record I drop to 29-30fps as if it was locking the game at that frame rate. Tried the same in WoW. I haven't had time to test if this would happens in my other games, but will update when I do so.
