Does the GPU usage occur if you untick "encode while previewing" in advanced options?
If it does: Remove any CLR/Browser scenes from the scene or set their size to 0x0 pixels and see if the GPU usage persists.

that option was unticked yes. i put the clr scenes to 0x0 all of them and usae actually went up slightly stuck at 97% i never had this problem with the gpu encoding but i want cpu encoding cause i have really good cpu now. unless i should switch back??

Hmm interesting. You could definitely try to use NVENC and see if that would fix anything which I kinda doubt. Maybe make a completely fresh scene and add things one by one to see what causes the GPU spike?

well i used nvenc when i was using my i3 but i try to use cpu cause i heard its better

another update. im test streaming with csgo. when im on main menu usage is around 35% but RIGHT when i get into game it pops right up to 97% and stays there. so its something with the game then? why is it doing this now with better specs??
