Question / Help Elgato game capture hd, 60fps stream temporarily out of sync.

I started streaming Mario kart 8 at 720p/60, using my Game capture hd and I have a small problem with it.

Basically the issue is this

90% of the time, it's fine. It's all synced up and the stream is fine. Occasionally it will lose sync for a few seconds, before sorting it self out. Strangely enough, every time it has done it, it has been at the start of the race. I clipped two races from twitch to show the issue and what I mean.

As you can see, no problem. Far as I can tell 9/10 races are like this.

Drops out of sync on loading screen before the race, but then corrects itself.

Both of those races are from the same stream session.

9/10 races are fine like the top one, and the ones that drop out of sync, are always like that. Out at the start, then correct themselves. They don't go out of sync mid race or drop in and out, it's always like that far as I can tell.

Not sure what the issue is, majority are fine like the top one.
OBS shows 0 dropped frames

Specs
FX-8350
8GB ram
5850 1GB
Elgato Game Capture HD

70/20 internet.
Twitch test shows 10000kbps+ to all EU servers (I am in EU).
Stream bit-rate is 2500
OBS + Game Capture HD software are both up to date.

Obs log from that session. I always preview my stream before going live, two streams in log, I assume one is the preview stream, but posted whole log anyway.
