Question / Help Disappearing layers while streaming old game (Battle Realms)

I tried to stream the rather old RTS game Battle Realms yesterday, but several layers of the game kept dissapearing/flickering in the stream. The layers that flickered were stuff such as buildings, visual effects such as flames and the whole GUI. I have already streamed a few games succesfully (Baldurs Gate, Dark souls, Dishonored, and emulated PS2 games) so I know my settings should work in theory. In my standart settings for a decent PC and not-that-much Upload, the layers flickered like crazy. When I incresed the fps, the flickering increased in frequenzy. Activating CBR, CFR and setting the x264 CPU Preset to 'slower' and the fps to 20 removed the flickering, but then the layers dissappeared every 30 secs or so and then over around 5sec gradually reappeared (First buildings and trees and stuff, then effects like flames, then the GUI) only to dissappear again after around 30sec. As this is an old game that does not work as long as a non 4:3 monitor is connected so I was streaming from a old monitor set to 1024:768, which equaled the ingame Resolution and I set the Resolution in OBS to that and did not use Res Downscale. I also had to use 'capture monitor' so I also activated 'Disable Aero'
I have never heard of such issue and some quick google revealed nothing. Has anyone any Idea whats happening here?

This is a DirectX 8 game, so game capture won't work with it. The only way to capture it is to run it in Windowed mode with Aero enabled and capture with Window capture. Trying to capture with Window capture or Monitor capture while it's running in fullscreen mode will cause the flickering you're describing.
