This is my internet connection:

This allows me to upload with a maximum speed of 1,25MB/s. The point is that I'm currently streaming with 3000kb/s and OBS shows a green box (like everything is alright) and no frames are dropped etc pp.
The stream works just fine

But how am I able to upload more than I actually can? it's not kbites, is it?

I thought kb is kilobytes.. then 1080p with only 400kByte/s seems pretty low to me.. I mean, 1080p needs to be more than 0,4MB/s

Small b is bits, uppercase B is bytes. For streaming we talk about bits, hence the name bitrate. And yes 3000 kbps is not enough for 1080p, but that's what you got to work with.
