Question / Help Avermedia live gamer hd fps problems

they transferred me twice to someone who could help and i ended up talking to an asian man who hardly understood what i was saying and I dont believe he really understood what i meant by saying the newest driver is locked at 30 fps and thought my capture card was broken or something which I told him it wasnt cause when i reverted to the old driver the card worked perfectly, eventually he just told me to open a support ticket on their website so calling them might now get us anywhere really
 
Unfortunately I currently do not know of a workaround for this.
The Avermedia card I use (game broadcaster hd) for example does not send the correct input resolution to OBS apparently. Unless I set a custom resolution it will try to use 1280x1024.

What I would suggest you is to setup two scenes (do not add the live gamer as a global source) and in one scene configure it to 1280x720 and in the other use 1920x1080.

Another idea (for a 720p stream) would be to set the Live Gamer to 1280x720 at 60fps, to my knowledge it should then downscale any 1080p input for you. But someone with a live gamer might correct me on this.
(In this case set OBS to 1280x720 too, in most cases you dont need any downscale)
my obs is setup like this the base is 1920x1080 downscaled to 1280X720 bilinear 60 fps and for my capture card i set it to 1280X720 and when i hit preview/stream i get like 44 fps at the most keep in mind i have a Intel i7-4770 with the preset to veryfast
