Looks like issues with the encoder. You should contact Elgato about it.

Hey, does this happen in the Game Capture software (Not OBS)?

I have emailed them.... I have it has only done it so fair when it is just sitting there then when I go to livestream with Elgato... it does it but i have not had any problems with OBS
