I've refined my options and I'm not sure I want to get into the splitting of hdmi signals. A splitter can be $30 anyway. So I figured I could just spend that money right away in an all in one solution. I'm currently undecided between the Livegamer HD, and the Elgato. Can anyone sway my opinion either way?

Live Gamer HD is a PCI-E card, which means you will have extremely minimal delay when capturing HD signals. It can also capture 1080p60 and downscale it to 720p60 on the card itself, rather than having to capture 720p60 directly.

The Elgato is a USB 2.0 capture card, and if you're capturing HD signals, you will have a 1-2 second delay on the capture due to the extra processing overhead needed in order to cram an HD signal over USB 2.0.

I would get the Live Gamer HD. I don't recommend ever getting an HD USB 2.0 capture device. If you need a USB capture device, then get a USB 3.0 capture device, such as the XCAPTURE-1.

My big thing is that I want to be able to stream my xbox at 60fps. I personally think it looks far far superior over 30 when playing an fps.

If you want to stream at 60fps, then you'll pretty much have to go with the Live Gamer HD, if those are the only two cards you're looking at. Outside of those, you can consider the XCAPTURE-1 or the SC-512N-L, both from Micomsoft, and both can capture at 1080p60. Though I don't recommend streaming out at 1080p60, mind you.

Of course. I just want a smooth 720p60 stream. I've just looked into the x-capture and the SC-512N-L and I think the livegamer is what I want. I'll be capturing from HDMI and I think the livegamer would work perfect.
