RTX 3070 100% NVENC encoder usage

My GPU usage literally shoots from 17-25% to 100% as soon as i load OBS in admin (I don't even have to click start streaming, just preview display capture), Can't get Game capture to cap any of my games either..... I have exhausted almost every option at this point and have no idea on how to fix this.....i7 6700k (4.3ghz) and MSI RTX 3070, followed all tutorials online but nothing has helped.
My games carry on playing just fine but while using the NVENC encoder to stream I get mad amounts of dropped frames, very frustrating.....

Tried changing my 3D Settings, problem persists......

Current NVIDIA Control Panel Settings (3D Settings)
