Bug Report Monitor and Window overlap

Hi, im having a problem where when i use either monitor capture or window capture with aero disabled i get an overlaping display glitch. 2 images of the problem

The problem is easily resolves by enabling aero but then my fps drops by at least half, and game capture crashed my obs!
Could someone please help me find a solution.
