First off, here is the analyze and log:

I am currently having a problem with my new pc and OBS. OBS is having a lot of FPS lag spikes when my game has focus. If I apply a frame limiter to the game I can stream it somewhat but that's not how it should be. On my previous PC it reduced the FPS in the game rather than OBS' fps.

Does anyone have an idea how to approach this problem. I have changed the power management to maximum performance for OBS in the nvidia control panel. I have tried pretty much every preset or resolution. OBS Studio is giving the same poor results. This only occurs when the game does NOT have focus, I can press on my browser window or obs window on another screen and see my fps stabilize. My CPU usage is around 35% when previewing, GPU usage 100%.

Is your system memory running in dual channel (or higher) mode? if you don't know grab CPU-z, run it and go to the memory tab. Top right, Memory #.

My memory is running in dual channel.

Is that correct or should it be something else?

I have used every x264 preset to no avail, I have it on very fast now. I am using monitor capture so I can drag anything to my main monitor without have to screen cap. Game capture has the same fps problems.

Try using Window capture on a program (or game capture on a game), and see if that clears up the issue for you.

Hmm... another GTX970 user with this issue... I think my theory is correct...

1. Make sure your drivers are up to date.
2. You can try OBs Studio and see if that does better for you. Even if it doesn't the log in there provides a bit more info in troubleshooting issues.

Thanks for the help. I managed to solve this myself and decided to come back to this topic if anyone finds this. The issue was solved when I installed windows 8 instead of windows 10. Having a solid 30 fps at 1080p while having 100+ fps ingame. Seems windows 10 does some weird thing with limiting gpu usage on non active programs.
