Question / Help High FPS - ingame//Low FPS\\stuttery stream

I've been having this problem ever since I swapped to my new system, I put the DXDIAG below on the attachments.
So the problem consists of low FPS in game, sometimes while streaming and I would have to turn the stream off then back on to try and fix the problem. I found some settings for MY obs that felt smooth for me keeping my game FPS high and preventing small stuttering problems on my end. Now take in mind, I never changed my settings, yesterday the streaming was perfectly fine and my ingame FPS was high and no problems on my side, however the stream was glitching/stuttering and wasn't a true 60FPS. (the obs fps is 49.9FPS avg and/or lower never staying at 60 whilst in game.)

MY PC:
I7 8700K @ 4.2GHz
16GB G.skill 15-15-15-35
GTX 1070 in SLI
SSD windows installed (obs is also on my SSD)
SSHD games installed

USING OBS STUDIO

My OBS settings in output are:
x264
Enforce streaming service encoder settings: CHECK
No rescale
Rate control: CBR
Bitrate: 3500
Custom buffer size: 3500
Keyframe interval: 2
CPU usage preset: Placebo
Profile: high
Tune: fastdecode//zerolatency

Video settings:
1280x720 BASE
1280x720 OUTPUT
downscale filter: bilinear
FPS: 60

Process priority: HIGH

I picked placebo because my CPU is practically top end and I should not have any kind of problems running games and streaming at the same time.

I looked at all my temperatures and not a single one of my parts is giving me problems.
At max my CPU can peak at 87C (idle temps with balanced performance can sit around 32C//AVG temps are around 60~76C
at max my GPU's can peak at 78~80C w/ fans at max (idle temps are 34C and AVG temps are around 66C)

Temperature is not a problem here.

I did notice however whilst streaming when I alt tabbed to check on my OBS is would tell my encoding overload, please lower video/encoding settings blah blah.
but when I tab back in it goes away.

I have no idea what my problem is here, I would greatly appreciate some help as to why I am having problems streaming.

Streaming with NVEC is fine, but my stream quality is very poor because NVEC is not a true CBR it's a VBR just with CBR tag.
Everywhere I've looked everyone has said that go with x264 over NVEC for stream quality, so I am going with x264, but I am running into huge performance problems that I should just straight up not have.

Welp I figured the problem out on my own!
just stream at a higher integer FPS meaning don't use straight 60FPS use an integer FPS from 61~90 (for optimal in game performance//stream performance, anything higher and stream can't keep up high framerate and in game fps lowers)
