Why don't I have the ability to check the capture layered windows box in the properties of monitor capture?

Why don't I have the ability to check the capture layered windows box in the properties of monitor capture?

Check in this area of settings: settings>video>disable aero

Tell me if that is checked.

Under Windows 8 this option will be grayed out, and yea as dacoder pointed out. If aero is disabled under Windows 7 it might be grayed out too.
Its useful for Windows 7 if you have aero active but have problems capturing parts of a window/monitor if I remember correct.
