OS: Windows 8
OBS v0.551b (and prior versions)
Game: Tom Clancy's Splinter Cell: Chaos Theory
Capture Mode: Game Capture (this game can not be Windowed)
I can capture the main menu, into the cutscene for a mission, into the pre-mission menu. Then it is time to load the actual mission to play. That is when the game used to crash if OBS was capturing it. I just discovered that by running the game in compatibility mode for Windows XP it will not crash. However, the video for OBS will stay stuck at the last frame before the mission loads. Alt-tabbing to OBS, opening then closing Game Capture Properties and Alt-tabbing back to the game will re-capture the game.
Here is a video demonstration: [Mod Edit: link removed per request] (Excuse the low FPS, it's because I was trying Windows 7 Compatibility Mode)
