What i mean by that is when elgato is actively being used it switches to recording mode but when it isnt it switches back to i think an auto detect mode... well every single time OBS disconnects for whatever reason it causes my elgato to go into a black screen for a few moments which is devastating if it happens during an important part. Was trying to stream mario 3d world the other day was on the last world boss challange and that happened nearly died, i did lose a power up.

What i want is it to NEVER stop being in active mode from the time obs is started. I keep searching the options menus in vain trying to see if there is an option to do so but never see it.

You should probably use a HDMI splitter or something rather than relying on the passthrough connection. The next version of OBS should help here in any case.

I would recommend simply not using Elgato's software. It is very limited in its capability and its generally much easier to simply add the elgato to OBS as a video capture device.

Well he has got a point to be honest, but the OBS rewrite will fix this anyways, as you'll always be in preview mode there and starting/stopping the stream will not unload the sources.

AndehX, he probably is using it as a video device in OBS, but he means that the pass through of the signal goes black for a small amount of time after starting/stopping to use the elgato. Since a disconnect in OBS will cause all sources to unload this indeed can cause problems as he described.
