So apparently this issue is well known, and for whatever reason we're having a nightmare trying to solve it. I just bought this card because I was tired of my videos being low quality, especially when it came to the faster-paced or more chaotic type of games. (my last card being the HD60 S, no issues there besides lower quality)
I've been searching around and eventually came across a post from Reddit saying that it's how the PC is handling because of how the card is programmed...? I'm not a hardware person, so don't ask me, lol.

Apparently it's possible to fix this by disabling some stuff in the BIOS, something I REALLY don't want to mess around with. But if someone who is also having this issue knows how to mess with this and pinpoint the issue here, we can test this out.
Something that I also did was monitor the CPU and GPU usage while using the capture software. The stuttering is way worse on OBS while the usage for both the CPU and GPU were very low. On Elgato's own software (4K Capture Utility), the stuttering was less frequent but still there, with the usage being higher.
It's like the PC isn't putting much into the card, which is causing these annoying stutters. Also based on that Reddit post, it seems the PC seems to go into "idle" mode and uses less power regardless if you're trying to capture/record with the card.
Like I said, I'm not the best when it comes to hardware or technical stuff like this. But...we need to figure this out, I really don't want to return this thing and go back to my USB capture device, at least that thing doesn't stutter for me. lol
EDIT: Something else I forgot to mention, OBS has less latency...is it possible this may be why the stuttering is worse? There's more on the Elgato software but has less stuttering. Also yeah I've tried the buffering option on OBS and it just made the stuttering even worse.
