crappy recording

1. yes stutter is in both preview and output see setting screen grabs
2. I've tried both usb 2 & 3 to no avail
3. I can't find anywhere a setting for refresh rates if you can point me in the right direction that would be great

to give you an idea of my setup
win7 laptop Nvida GeForce 610m, Kworld DVD maker 2 and/or Easier CAP and the latest Stable OBS software
PLEASE HELP this is doing my head in

You have 32-bit version of OBS running.
Please provide a complete obs log here containing one of your recordings.

Your "tv pic" is massively cropped with resulting blurriness. We can't see what you mean with your questions 1 & 3 in detail.
Overall it seems that your system is weak and outdated for such purpose...

Support for win7 is at free will here in the forum. OBS isn't officially supported for win7 any longer, although alot of people still using.

1. Camera Pluged into TV no horizontal lines
2. OBS screen grab while recording highlighted horizontal lines
3. play back through VCL highlighted horizontal lines

Yesssss. Now its (at least) a bit more clear. :)

So you don't mean "stutter". It's more typical "line hop" due to the PAL principle - the i50 (interleaved pictures) format. It's equivalent to p25 format: Two adjacent pictures do deliver a complete picture, one provides the odd lines, the other provides the even lines, so every 1/25 second a complete picture is there.

Unfortunately (at horizontal movements in the movie) these two "half-way" pictures contain different horizontal locations of the pixels due to differnt time each picture taken. So the "horizontal lines" you mean do appear (turn up) during horizontal movement in the movie, right?

Did your capturing device support "deinterlace" option?

It looks (a bit like) your capturing device is upscaling the content first and then tries to deinterlace.
Deinterlace must take first place before upscaling and/or converting into any target resolution.
You should have a talk with your supplier of that capturing card.
