Question / Help AVerMedia Live Gamer HD with obs can't get smooth 60 fps

So the problem is that I can't get smooth 60 fps while streaming by using my live gamer hd. It's not about any fps drops or something like that and I know my pc specs and I also know that I don't have any kind of fps drops while playing games. So can you guys explane me why I can get smooth 60 fps when I use capturing game directly through obs but with same settings with my capture card setup on 1280x720 60 fps I can see my stream running like on 30/40 fps ?
I wan't to use overlay and the other stuff on my stream but I want it to be smooth 60 fps with my capture card. Is there any chance to explane me why it is like this or someone maybe can guide me please.
My obs setup is:
2,5k bitrate
x264
Resolution 1920x1080 downscale to 1280x720 to be same with capture card and I already tried it without downscale
Filter Lanczos
60 fps
Scene buffering time 400 already tried 700
Preset already tried everything without results
Encoding main
Use cfr
My pc specs
Radeon r9 280 3gb
i7 3770
12 gb ram
I can record at 60 fps with this card but can't stream with 60 fps wheres the problem ? Maybe im missing some plugins or it's something with obs.

Did obs displays constantly 60fps in the bottom right?
Have you try a different filter yet?

And please post a logfile.

Remember: this card can only record 1080p60, not stream. Stream maximum is 720p60, but since you say you downscale to that, that should be a problem with card or settings.

Obs is showing constantly 60 fps while streaming.

It's reportedly a problem in the latest version of the avermedia software from what I've seen.
