Recording footage stuttering and choppy with CQP on but smooth on CBR

So I have a problem, with CBR my recording footage is smooth but when I try to run with CQP (doesnt matter what quality level) the game footage is stuttery.
I have no idea what could be the issue, I've tried running OBS as admin limit my FPS etc but it doesn't help.

My specs are: 5800x3d, rx 6800 with 32 gb ram running windows 11 and the recorded footage is saved on an SSD.

PC stats during gameplay (notice how GPU 3d rendering usage is at 100% but video decode which I suppose is the AMD hardware H.265 encoder is around 75% utilized):

I experience the same behavior.
My RX 5700 XT broke and i needed to change to a new GPU, got a the 7900 xtx very cheap and see the same as you do on windows and linux.
