ok so Only when I stream using the most recent version of OBS my mic mutes itself within windows audio device properties, no hotkeys at all are set up in obs, and I have tried giving exlclusive control and not giving exclusive control, I have reinstalled the driver, I am running the most recent version of windows. have restarted bot obs and the computer multiple times, tried different usb ports. unsure of why this is happening and any help would be greatly appreciated.

Just wanted to reply back with the results of some more testing, I attempted to re-create the issue while recording and it does not happen, when going live and streaming to twitch it happens every couple of minutes, these issues were not happening yesterday while streaming and cropped up out of nowhere today, please feel free to check out my recent vods on twitch from today to witness the issue happening, or from yesterday to confirm that it was working solid.

Take your mic off of your webcam. You currently have it set as an external audio device under your webcam properties. Instead, you should be adding your mic as a separate audio source.

If that does not fix things, you may either need to try a different USB port, or update your motherboard's BIOS/drivers.

gonna need you to clarify "take your mic off webcam for me"

3:39.100: audio device: Microphone (3- AT2020USB+) it says its using my at2020 (which is notthe webcams mic) the only other options to change it to are for my elgato game capture... there is no "take it off" option...
additionally the audio output mode of the webcams properties inside of obs is set to "capture audio only" the only options there are "output desktop audio (direct sound) and "output desktop audio (Wave out)

by the way the mic is already added as its own source. if you took the time to read I have already stated that different usb ports have been tried and BIOS/ Drivers are already up to date. please read next time.

Uncheck "Use Custom Audio Device".

And yep, reading is fun. I'm specifically talking about USB drivers for the motherboard, not the mic drivers (which I don't believe it has anyway). I'm suspecting there's an issue with it just not getting the power it needs.
