I need help with Capture Card (EZCAP 360Q)

Hello friends. I'm new here.

Well, my problem is: I've bought recently a EZCAP capture card model 360Q (Game Dock Extreme) which is supposed to record in 4k 60 FPS in MJPEG video format.
The problem I've been facing is I can't record in that resolution and frame. When I set 4k 60FPS the frames drop and reach the highest level of 37-45 FPS.
On 2k resoution or even lower, all work properly. What I also see, MJPEG overload CPU which goes up to 4% depending on the scene. Other video format works normally. I'm using NVIDIA NVENC (all drivers updated).

My Setup is:
- Intel core i7 12th
- 32 Gb RAM
- SSD 1 TB
- Nvidia RTX 3070 8gb VRAM
- Windows 11
- Directx 12
