Not to mention I have had this program for around three straight hours and haven't been able to capture not even one video as the Stopping Recording feature gets stuck everytime cutting my videos down to seconds. Please help me out, I'm sure it's just the hardware feature for encoding but it is just not there and I have no idea why, is there a way to download it?

I installed the AMD Encoder 2.3.2 twice, and it literally did nothing.... it said it would have the hardware option but was clearly false advertisment....

Considering the hardware in your system, it wasn't false advertisment. If your system doesn't have the hardware to support the AMD hardware encoder, it won't show up.
