Question / Help Fps drop when steaming and encoding with GPU (Not bottlenecking)

Hi all,

New to OBS. Recently had issues with streaming but fixed it with the encoder settings. Stream now runs perfectly at 60fps at 720p. The issue im still having is that the frames are up and down from high 30's to 60fps when I stream. Normally i would think my system is being pushed too hard but the GPU usage according to task manager, never seems to reach about 40%

Game I'm streaming is Assassin's Creed Brotherhood. Playing it at 60fps 1080p (stream downscaled to 720p)

I'm using a GTX 1070, an i7700hq, 32gb ram, windows 10

It's as if only a certain amount of the GPU will be dedicated to the game and that specific space is also being used with OBS, but I'm just speculating of course. My laptop is more than enough to run this 9 year old game and single player doesnt lock your frame rate so its goes to 120fps on that.

Windows is out of date and game mode is on; however, this would usually have the effect of degrading OBS performance in favor of your game, and I don't see any rendering lag that is the usual symptom of that problem.
