Capture card running 30fps at every resolution, but says it can run 1080P at 60 :(

So i got a OMEN Victus 15 windows 11 laptop last year, and a couple moths ago i heard about Capture cards, and i bought one yesterday. its this one:

i have an Xbox series S so i thought it would be nice to be able to hook it up to my pc to stream! so i set it up in obs, and its running 30 fps, with weird rapid lag spikes (i think) im not sure what to do, so im hoping one of you expert tech guys can see whats up! heres the log file:

Make sure it's plugged into a USB 3 slot (blue colored jack) and you're using a USB 3 capable cable (blue colored plugs).
