Question / Help Bitrate going over maxbitrate H.264 encoder

Hello everyone

I have a bit of a strange problem that I don't really understand... any help would be really appreciated!

Now, let me say I'm a newbie at streaming, and sorry if this has been discussed before, I tried searching on google to no avail.

Here's the thing:
I'm trying to stream a CPU heavy game (The Division), and I can't seen to use x264 without severely impacting my game performance (sometimes the encoder uses up to 30% CPU and then the game falls to 10fps which is unplayable)

I was messing with the settings and noticed there's a hardware encoder, H.264, which I assume makes the encoding happen on the GPU instead of CPU, since my CPU usage went to 9% using that.

Which was great because now I can play with a good FPS and stream without dropping any frames.
But sometimes (not really often but like every 30 minutes or so) my bitrate would go way up from the max bitrate that I set,
up to 3500kbps (from the max bitrate of 2200kbps set on my config), and that's enough to make my stream freeze and buffer for everyone since my internet connection cannot handle that much bitrate.

So here's my question: Anyone knows why that happens and how to fix it? I thought the max bitrate would prevent it from going up?
