14% fps loss just from opening obs when gpu limited (rtx 3060)

I set up a scenario in a game to test this where i'm 100% gpu limited and the fps variation is less than +/-1.

No obs: 108 fps
opening obs just with game capture: 101 fps
adding 1080p webcam over game capture: 95 fps
starting to record with nvenc: 90 fps (4%-5% loss from recording is expected)

On my 1050 ti on the exact same test I did not loose any fps until I started recording and lost the expected 4%-5% I experience on every gpu I tested (1050 ti, 1070, 1080 ti).

I did the same test in a slightly different location with shadowplay:
no shadow play: 97 fps
shadowplay and overlay running: 97 fps
recording with shadowplay: 93 fps (the expected 4% loss)

I noticed that minimizing obs gives me 3% fps back, and disabling preview gives me 1% fps back, so something else is still using about 10% of my gpu's core and killing my fps. This does not happen on the much weaker 1050 ti so obs is not "supposed to" be using that much just to render scenes.

I tried hardware gpu scheduler on/off and the results did not change at all. I am also running as admin. This fps loss happens in every single game where I am gpu limited.
